These Terms and Conditions govern the use of the Comlyzer digital platform, an analytics tool for reading and analyzing social media comment sections.

3.1 Agreement

By accessing, registering or using the Platform, the User declares to have read, understood and fully accepted these Terms and Conditions.

3.2 Legal Capacity

The User declares they have legal capacity to enter into contracts and fulfil the obligations arising from these Terms.

3.3 Changes

We reserve the right to amend these Terms and Conditions at any time. Changes will take effect on the date they are published on the Platform. Continued use of the Platform after changes constitutes acceptance of the new terms.

4.1 Available Services

The Platform offers:

• Comment ingestion from public TikTok videos
• Sentiment scoring, topic clustering, and top-fan detection
• CSV export and multi-account workspaces
• Account management, billing, and email notifications

4.2 Availability

While we strive to keep the Platform available 24/7, we do not guarantee uninterrupted availability. Interruptions may occur for maintenance, updates or technical reasons.

5.1 Account Creation

To use certain services, the User must create an account by providing accurate and up-to-date information.

5.2 User Responsibilities

The User agrees to:

• Provide truthful and up-to-date information
• Keep their access credentials confidential
• Immediately notify any unauthorised use of their account
• Be responsible for all activities carried out on their account

5.3 Suspension and Cancellation

We reserve the right to suspend or cancel accounts that violate these Terms and Conditions.

6.1 Permitted Use

The Platform is intended for analyzing public TikTok comment sections for creators, brands, and agencies.

6.2 Prohibited Use

It is expressly prohibited to:

• Use the Platform for illegal or unauthorised purposes
• Attempt to access restricted areas of the Platform
• Interfere with the normal operation of the Platform
• Reproduce, distribute or modify Platform content without authorisation
• Use automated systems to access the Platform

7.1 Current Pricing

Comlyzer offers two pricing tiers: Creator and Brand. Both are monthly subscriptions billed through Stripe. Prices are displayed in USD, EUR, or GBP based on your location.

7.2 Payment Processing

• Payments are processed through Stripe, a secure third-party payment system
• We do not store credit card information
• Prices are displayed clearly before any purchase
• Subscriptions renew automatically until cancelled from your profile

8.1 Provider Rights

All intellectual property rights over the Platform, including but not limited to:

• Source code and design
• Trademarks and logos
• Original content and algorithms
• Texts, images and graphic elements

Are the exclusive property of João Rocha de Carvalho.

8.2 Usage Licence

We grant the User a limited, non-exclusive and revocable licence to use the Platform in accordance with these Terms.

8.3 User Content

The User retains all rights over the content they create. We only process that content to provide the service.

9.1 Data Processing

The processing of personal data is governed by our Privacy Policy and the General Data Protection Regulation (GDPR).

9.2 Purposes

Personal data is processed exclusively for:

• Providing the SaaS boilerplate services
• Managing the User's account
• Service-related communications

9.3 Security

We implement appropriate technical and organisational measures to protect personal data against unauthorised access, alteration, disclosure or destruction.

10.1 Disclaimer of Warranties

The Platform is provided "as is". We do not guarantee that:

• The service will be uninterrupted or error-free
• Results obtained will meet specific needs
• All defects will be corrected

10.2 Liability Limitation

Our liability is limited to the one-time payment amount paid by the User for the Vibe-coder or Founder tier.

10.3 Exclusions

We are not responsible for:

• Indirect, special or consequential damages
• Loss of profits, data or business opportunities
• Actions of third parties
• Failures of external systems

11.1 Negotiation

In case of dispute, the parties agree to first attempt to resolve the matter through direct negotiation.

11.2 Mediation

If negotiation is unsuccessful, the parties may resort to mediation through a competent body.

11.3 Jurisdiction

For disputes that cannot be resolved by other means, the courts of Évora, Portugal shall have jurisdiction.
